By accessing or using TeacherDesk ("the Service"), provided by BrightWave Technology LLC, you agree to be bound by these Terms of Service. If you are using the Service on behalf of a school or organization, you represent that you have the authority to bind that entity to these terms.
2. Description of Service
TeacherDesk is an AI-powered teaching assistant platform designed for K–12 educators. The Service provides tools including lesson planning assistance, translation, self-evaluation, and related features accessible via a web-based interface.
3. Eligibility
The Service is intended for use by licensed educators, school administrators, and authorized school staff. Users must be 18 years of age or older. TeacherDesk is not intended for direct use by students.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately at support@teacherdesk.net if you suspect any unauthorized use of your account.
5. Subscriptions and Payment
TeacherDesk is offered on a subscription basis. By subscribing, you authorize BrightWave Technology LLC to charge your payment method on a recurring basis according to your selected plan. Subscriptions automatically renew unless cancelled before the renewal date.
- All fees are quoted in U.S. dollars.
- Refunds are not provided for partial billing periods.
- We reserve the right to adjust pricing with 30 days' notice.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Upload or transmit student personally identifiable information (PII) beyond what is necessary for the Service
- Attempt to reverse-engineer, copy, or redistribute any part of the platform
- Use automated tools to scrape or overload the Service
- Share account credentials with unauthorized users
7. Data and Privacy
Our collection and use of information is governed by our Privacy Policy, which is incorporated into these Terms by reference. We comply with applicable federal and state laws regarding student data privacy, including FERPA.
8. Intellectual Property
All content, software, and materials provided through TeacherDesk are the property of BrightWave Technology LLC or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for your school's internal educational purposes only.
9. AI-Generated Content
TeacherDesk uses artificial intelligence to generate suggestions, lesson plans, translations, and other content. AI-generated content is provided as a starting point and should be reviewed by the educator before use. BrightWave Technology LLC does not guarantee the accuracy, completeness, or suitability of any AI-generated output.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. BrightWave Technology LLC does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
11. Limitation of Liability
To the maximum extent permitted by law, BrightWave Technology LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid in the three months preceding the claim.
12. Termination
We reserve the right to suspend or terminate access to the Service at any time for violation of these Terms. Upon termination, your right to use the Service ceases immediately. You may cancel your subscription at any time through your account or by contacting support.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or a notice on the platform. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Nevada, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Clark County, Nevada.
